Guyana leading way in legislative framework against terrorism  

Guyana is significantly ahead of CARICOM in implementing regulations related to terrorism, having amended its legislation over two decades ago to address such issues, Attorney General Anil Nandlall said.

CARICOM is actively addressing terrorism, particularly its evolving links with organised crime and violent gangs.

The CARICOM Heads of Government recently adopted a Counter-Terrorism Strategy that emphasises preventing violent extremism, strengthening defences against attacks, and promoting tolerance.

This strategy also focuses on legislative changes and enhanced surveillance measures while upholding human rights.

Recognising the transnational nature of these threats, CARICOM has adopted a regional approach to address them effectively. Member states are now implementing these measures.

However, Nandlall pointed out that Guyana has been ahead of the curve, having made these necessary legislative adjustments as early as 2002—23 years before other member states.

Section 309A of Guyana’s Criminal Law (Offences) Act, amended in 2002, defines terrorism as acts committed with the intent to strike terror among the population, including actions likely to cause death or injury.

It also covers advocating, aiding, abetting, or inciting such acts. Specifically, it criminalises the use of firearms or other lethal weapons to cause harm, as well as other methods leading to damage, destruction, or disruption.

CARICOM’s strategy aims to prevent violent extremism by denying terrorists the means and opportunities to operate while enhancing preparedness against attacks.

It is considering legislative reforms to boost its counter-terrorism capacity, including improved surveillance and detention measures, while maintaining a strong focus on human rights.

CARICOM is also fostering collaboration among member states and with international partners to strengthen its counter-terrorism efforts.
