The Guyana Police Force has announced its intention to appeal a recent decision by the Mahaicony Magistrate’s Court, which granted bail to Dennis Persaud. Persaud, a 37-year-old businessman from Lot 5, West Strathavon, Cane Grove, East Coast Demerara, was charged under the Cyber Crime Act No. 16 of 2018.
He was arrested on Tuesday, 29th April 2025, by ranks of the Criminal Investigation Department, Headquarters. On Friday, 2nd May 2025, he was formally charged with using a computer system to incite others to commit a terrorist act. The specific allegation relates to encouraging the burning of speed cameras, an offence under Section 18(1)(d)(ii) of the Cyber Crime Act.
Later that day, Persaud appeared before Magistrate Allan Wilson. Though the Police Prosecutor objected to bail, the court granted it in the sum of $150,000. The Police Force has expressed strong disagreement with this decision, citing the serious nature of the alleged offence and the risk it poses to public safety and infrastructure. They believe the ruling does not align with recent decisions in similar matters and have taken active steps to file an appeal.
The case has been adjourned to 3rd June 2025 for report and statements.
