CCJ interim stay: Forde welcomes ruling, Nandlall maintains appeal unlikely to succeed

The Caribbean Court of Justice (CCJ) has set April 21, 2026, to hear the application for special leave to appeal filed by the Mohameds, with the matter to be conducted via video conference.

In orders issued today, the Court outlined strict timelines, including deadlines for affidavits and written submissions in early April.

Importantly, the CCJ ruled that the special leave application will be treated as the substantive appeal, allowing for a final determination at the upcoming hearing.

The panel hearing the matter includes CCJ President Winston Anderson, along with Justices Maureen Rajnauth-Lee and Chantal Ononaiwu.

The Court also granted an interim stay of the extradition proceedings in the Magistrates’ Court until the appeal is determined or further orders are made.

Attorney for the Mohameds, Senior Counsel Roysdale Forde, welcomed the ruling, noting that it allows the Court time to fully consider the appeal before any further action is taken in the Magistrates’ Court. He said: “The CCJ stated that they were granting the order in the interest of justice.”

Meanwhile, Attorney General Anil Nandlall said the decision by the Caribbean Court of Justice to grant a stay in the extradition proceedings involving the Mohameds is a standard measure by a final court to preserve the status quo.

Speaking following the case management conference, Nandlall explained that, while the State opposed the stay and the appeal, the Court acted in line with established practice, pausing the Magistrates’ Court matter until the appeal is determined.

He noted that the CCJ also stressed the urgency of the case and issued strict timelines.

The Attorney General maintains that the appeal has little likelihood of success and says the matter should be concluded swiftly in the public interest.
